DuoTrip — Terms of Use

Welcome to DuoTrip. These Terms of Use (“Terms”) govern your access to and use of the DuoTrip website, mobile application, platform, games, events, community features, content, and related services (collectively, the “Service”).

By accessing or using DuoTrip, you agree to these Terms. If you do not agree, you must not use the Service.

1. About DuoTrip

DuoTrip is a platform designed for couples to discover experiences, connect with other couples, participate in games, explore events, communicate, and enjoy shared social, travel, and local experiences.

DuoTrip may include social features, messaging, event discovery, recommendations, interactive games, user profiles, photos, and other community-based experiences.

2. Eligibility

You must be at least 18 years old to use DuoTrip.

By using the Service, you confirm that:

1. You are at least 18 years old.
2. You have the legal capacity to enter into these Terms.
3. You will use the Service only for lawful purposes.
4. Any information you provide is accurate and up to date.
5. You will not use DuoTrip to exploit, harm, harass, deceive, or pressure any person.

We may suspend or terminate accounts if we believe a user is under 18 or has violated these Terms.

3. Account Registration

To use certain features, you may need to create an account. You are responsible for keeping your login credentials secure and for all activity under your account.

You agree not to:

1. Create an account using false information.
2. Impersonate another person or couple.
3. Share your account with unauthorized users.
4. Use another person’s account without permission.
5. Create multiple accounts to bypass restrictions or enforcement.

4. Couple Profiles and User Information

DuoTrip may allow users to create couple profiles, add preferences, upload photos, describe interests, join games, browse experiences, and interact with other users.

You are responsible for the information you submit. You must not upload or share content that violates the rights, privacy, consent, safety, or dignity of another person.

5. User Content

“User Content” means any content you submit, upload, post, send, display, or make available through DuoTrip, including photos, profile information, messages, game responses, event comments, and other materials.

You retain ownership of your User Content. However, by using the Service, you grant DuoTrip a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, adapt, moderate, remove, and use your User Content as necessary to operate, improve, promote, and provide the Service.

You confirm that:

1. You own or have the necessary rights to the content you upload.
2. Your content does not violate any law or third-party right.
3. Every person shown or referenced in your content has given appropriate consent.
4. Your content does not include minors in any adult, suggestive, romantic, sexual, or inappropriate context.

6. Prohibited Content and Conduct

You may not use DuoTrip to post, send, promote, request, or engage in content or conduct that:

1. Is illegal, abusive, threatening, harassing, hateful, defamatory, or discriminatory.
2. Involves minors in any inappropriate, sexual, romantic, exploitative, or unsafe context.
3. Promotes violence, coercion, abuse, trafficking, exploitation, or non-consensual activity.
4. Includes nudity, explicit sexual content, pornography, or sexually explicit media unless expressly allowed in a clearly designated feature and permitted by applicable law and platform rules.
5. Shares private information about another person without consent.
6. Impersonates another person or misrepresents your identity.
7. Violates intellectual property, privacy, publicity, or contractual rights.
8. Sends spam, scams, phishing messages, malware, or unauthorized promotions.
9. Uses automated scraping, bots, crawlers, or unauthorized data collection.
10. Attempts to reverse engineer, disrupt, hack, overload, or interfere with the Service.
11. Uses DuoTrip for prostitution, escort services, trafficking, or any illegal commercial sexual activity.
12. Pressures, manipulates, blackmails, threatens, or coerces another user.

DuoTrip may remove content, restrict features, suspend accounts, or report activity to authorities when appropriate.

7. Safety, Consent, and Real-World Meetings

DuoTrip may help users discover events, activities, and other couples. However, DuoTrip does not guarantee the identity, intentions, background, health, safety, or behavior of any user.

You are solely responsible for your interactions with other users, online and offline.

You agree to:

1. Respect boundaries and consent at all times.
2. Communicate clearly and honestly.
3. Meet in safe public or appropriate places when relevant.
4. Avoid sharing sensitive personal information too early.
5. Report suspicious, abusive, unsafe, or non-consensual behavior.

DuoTrip is not responsible for the conduct of users or for any harm, loss, dispute, injury, or damage resulting from interactions between users.

8. Games and Interactive Experiences

DuoTrip may offer games, prompts, questions, challenges, or interactive experiences for couples or groups.

Games are for entertainment only. You are responsible for deciding whether to participate in any game, question, challenge, or activity.

You must not use games or prompts to pressure, embarrass, manipulate, expose, or coerce another person. Participation must always be voluntary and consensual.

9. Events, Travel, and Third-Party Activities

DuoTrip may display or promote events, travel ideas, activities, venues, or third-party services.

Unless explicitly stated otherwise, DuoTrip does not own, operate, control, or guarantee third-party events, venues, travel services, organizers, hosts, accommodations, transportation, or experiences.

You are responsible for reviewing all event details, cancellation terms, safety considerations, travel requirements, and third-party policies before participating.

DuoTrip is not responsible for:

1. Event cancellations or changes.
2. Travel delays or losses.
3. Third-party conduct.
4. Venue safety.
5. Payment disputes with third parties.
6. Inaccurate information provided by third parties or users.

10. Paid Features and Subscriptions

DuoTrip may offer paid features, premium access, subscriptions, event tickets, boosts, virtual features, or other purchases.

Prices, features, billing periods, and cancellation rules will be shown at the time of purchase. Payments may be processed by third-party providers such as Apple, Google, Stripe, or other payment processors.

Where purchases are made through an app store, cancellation and refund rules may be governed by that app store.

Unless required by law or expressly stated otherwise, payments are non-refundable.

11. Privacy

Your privacy is important to us. Our collection and use of personal information is described in our Privacy Policy.

By using DuoTrip, you agree that we may process your information as described in the Privacy Policy.

12. Intellectual Property

DuoTrip, including its name, logo, design, software, features, visual style, text, graphics, interfaces, and technology, is owned by DuoTrip or its licensors and is protected by intellectual property laws.

You may not copy, modify, distribute, sell, lease, reverse engineer, or exploit any part of the Service unless we give written permission.

13. Feedback

If you provide suggestions, ideas, comments, or feedback about DuoTrip, you grant us the right to use them without restriction or compensation.

14. Account Suspension and Termination

We may suspend, restrict, or terminate your account if we believe that:

1. You violated these Terms.
2. Your conduct may harm DuoTrip, users, or third parties.
3. Your account is fraudulent, unsafe, or misleading.
4. We are required to do so by law, app-store rules, or a legal request.

You may stop using DuoTrip at any time. You may also request account deletion by contacting us at the email below.

15. Disclaimers

DuoTrip is provided on an “as is” and “as available” basis.

We do not guarantee that:

1. The Service will always be available, secure, or error-free.
2. User profiles or content will be accurate.
3. You will find compatible couples, events, or experiences.
4. Any real-world interaction will be safe or successful.
5. Third-party services will meet your expectations.

To the fullest extent permitted by law, DuoTrip disclaims all warranties, express or implied.

16. Limitation of Liability

To the fullest extent permitted by law, DuoTrip and its owners, employees, contractors, partners, and affiliates will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of data, profits, goodwill, reputation, or opportunities.

DuoTrip is not liable for user conduct, third-party conduct, events, travel arrangements, offline meetings, or content posted by users.

17. Indemnification

You agree to defend, indemnify, and hold harmless DuoTrip and its owners, employees, contractors, partners, and affiliates from any claims, damages, losses, liabilities, costs, and expenses arising from:

1. Your use of the Service.
2. Your User Content.
3. Your violation of these Terms.
4. Your violation of any law or third-party right.
5. Your interactions with other users.

18. Changes to the Service or Terms

We may update the Service or these Terms from time to time. When we make material changes, we may notify you through the Service, by email, or by posting an updated version.

Your continued use of DuoTrip after changes become effective means you accept the updated Terms.

19. Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts, USA, without regard to its conflict-of-laws principles, unless mandatory consumer protection laws in your country require otherwise.

Any dispute will be handled in the state or federal courts located in Suffolk County, Massachusetts, unless applicable law provides otherwise.
